1. General & Service Nature

MTWSPY is an online data-aggregation tool and analytical interface that provides search and monitoring access to publicly available advertising materials, creatives, and landing pages collected from third-party networks.

MTWSPY is an independent data indexer and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with Meta Platforms, Inc., Facebook, or any of their subsidiaries.

By accessing or using the service, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the service.

2. Eligibility

You must be at least 18 years old to use the service. By using MTWSPY, you confirm that you have the full legal capacity to enter into this agreement and that your use of the service does not violate any applicable law or regulation in your jurisdiction.

3. Account Security and Termination

• Users must register an account to access the service. You are solely responsible for maintaining the confidentiality and security of your account credentials.
• You may not share, transfer, lease, or resell access to your account to any third party.
• MTWSPY reserves the right to suspend, restrict, or terminate any account at any time, with or without notice, at its sole discretion, without explanation and without liability.

4. Service Description & Third-Party Content

MTWSPY automatically aggregates data from publicly accessible sources, specifically the public Facebook Ad Library.

• No Verification: We do not create, modify, host, moderate, or verify the content, links, redirects, landing pages, or pre-landing pages displayed through our tool.
• No Endorsement: The inclusion of any advertisement, product, domain, or landing page within MTWSPY does not imply endorsement, approval, or recommendation by MTWSPY.
• "As Is" Basis: The service is provided strictly on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, legality, safety, or availability of the aggregated data.

5. Prohibited Actions & Strict Anti-Scraping Policy

You are granted a limited, non-exclusive, non-transferable, and revocable license to access MTWSPY strictly for analytical purposes via our official user interface.

You are strictly prohibited from:

• Scraping and Data Extraction: Using any automated tools, bots, spiders, scrapers, scripts, harvesters, or AI models to extract, copy, clone, or monitor data, text, images, or code from the MTWSPY platform, database, or infrastructure.
• Commercialization: Reselling, redistributing, syndicating, or sub-licensing access to MTWSPY or any data obtained through it to third parties.
• Reverse Engineering: Attempting to decompile, reverse engineer, or discover the source code or underlying algorithms of the MTWSPY platform.
• Infrastructure Abuse: Overloading, bypassing rate limits, or interfering with the working order, security, or integrity of MTWSPY systems.
• Rate Limiting & Fair Usage: MTWSPY enforces strict rate limits on database queries and page loads to maintain platform stability. Any attempt to bypass these limits, forge request headers, or generate unnatural traffic volume will be flagged as system abuse.

Any violation of this section will result in immediate and permanent account termination without prior notice and without any refund, and MTWSPY reserves the right to pursue legal remedies and financial damages under applicable law.

6. Disclaimer: Third-Party Advertising Content

The data indexed by MTWSPY is publicly available and is sourced from the Facebook Ad Library. It may include advertising materials from a wide range of industries and advertisers.

MTWSPY does not create, control, verify, or endorse the claims, licenses, or legality of any indexed advertisement. MTWSPY explicitly disclaims any responsibility for how users interpret, evaluate, or utilize these materials. You operate entirely at your own risk.

7. Limitation of Liability for Third-Party Materials & Landing Pages

To the maximum extent permitted by applicable law, MTWSPY, its owner, and operators shall not be held liable for:

• The content, legality, or safety of any third-party landing pages discovered through the service.
• Any malware, phishing, scams, or malicious scripts present on third-party domains indexed by our tool.
• How users interpret or act on the information found via MTWSPY. What users choose to do with the indexed information is outside our control, knowledge, and liability.
• Any actions taken against your advertising accounts, business managers, or profiles by Meta/Facebook or any other advertising platform. You are solely responsible for ensuring that any use of insights derived from the service complies with applicable laws, intellectual property rights, and the policies of the relevant advertising platforms.
• Any financial losses, business interruptions, or damages resulting from the use of data obtained through MTWSPY.

8. Payments, Subscriptions, and Refunds

• Access to MTWSPY is billed on a subscription basis. Payments are securely processed through third-party billing providers. We accept major cards (Visa, MasterCard, etc.); alternative payment methods are also available. MTWSPY does not store your full payment card credentials.
• All purchases are final. Refunds are issued solely at our absolute discretion.
• No refunds will be granted if an account is suspended or terminated due to a violation of these Terms (including scraping attempts, rate-limit abuse, or account sharing).

9. Intellectual Property

• MTWSPY owns all rights, titles, and interests in the platform, software, codebase, interface design, branding, and proprietary infrastructure.
• All third-party trademarks, logos, ad creatives, and landing page contents remain the intellectual property of their respective owners. MTWSPY claims no ownership over indexed third-party materials.

10. Intellectual Property Complaints & Take-Down Procedure (DMCA)

MTWSPY respects the intellectual property rights of others. If you are a copyright owner or an authorized agent thereof and believe that any content indexed by our automated tool infringes upon your copyrights, you may submit a removal request. To request the removal of specific advertising materials from our index, please contact us at support@mtwspy.com with the following information:

• Clear identification of the copyrighted work claimed to have been infringed;
• The specific URL or identifier within MTWSPY where the material is located;
• Your contact information (name, address, telephone number, and email);
• A statement that you are the rightful owner or authorized to act on behalf of the owner. Upon receipt of a valid request, MTWSPY will promptly remove or disable access to the disputed material.

11. Fair Use Notice

This service indexes and displays publicly available marketing materials for archival, analytical, research, and educational purposes only. MTWSPY believes this constitutes a "fair use" of any such copyrighted material as provided for under applicable international copyright laws. If you wish to use copyrighted material from this service for purposes of your own that go beyond "fair use", you must obtain permission from the copyright owner.

12. Network and Access Compliance

Users are permitted to access MTWSPY via standard web browsers. While the use of VPNs or proxies is not strictly prohibited, users remain entirely responsible for ensuring that their method of connection and geographical location comply with Slovakian and European trade compliance, economic sanctions, and local regulations. You agree not to use the service if you are located in a jurisdiction subject to comprehensive international sanctions.

13. Governing Law and Jurisdiction

These Terms of Service, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Slovakia.

Any legal suit, action, or proceeding arising out of these Terms or the use of the service shall be instituted exclusively in the competent courts of Slovakia.

14. Modifications to Terms and Service

MTWSPY reserves the right to modify or replace these Terms at any time. The most current version will always be posted on this page. Your continued use of the platform after any changes indicates your explicit acceptance of the new Terms.
